Decision to prosecute satirist in Germany worrying, OSCE media Freedom Representative says, reiterating call to decriminalize defamation.

OSCE  Representative on Freedom of the Media Dunja Mijatović today expressed concern about the decision in Germany to prosecute a satirist who derided the President of Turkey, Recep Tayyip Erdoğan. 

“This case shows that legal provisions, albeit dormant for long periods of time, may be revived and could endanger Free expression in any Democratic society,” Mijatović said.

Today it was announced that German authorities will launch a criminal investigation into satirist Jan Böhmermann under Article 103 of the Criminal Code, following a request by the President of Turkey who claimed he was insulted by a poem broadcast on 31 March by the German television station ZDF.

“This debate shows the need, and also provides an opportunity, to review the current criminal law in Germany, which criminalizes insult and defamation and comprises a provision imposing fines and imprisonment for insult of a foreign head of state,” Mijatović said.

The Representative said that the outcome of this case could have an immense effect on Freedom of Expression, including Artistic Freedom, in Germany and beyond.

Mijatović reiterated her position on the issue in her letter to German Minister of Foreign Affairs and OSCE Chairman-in-Office Frank-Walter Steinmeier.

In the letter Mijatović stressed that political speech, views on religion, opinions and expressions which are favourably received or regarded as inoffensive, but also those that may offend, shock or disturb are covered by the freedom of speech and these forms have been upheld by numerous decisions of the European Court of Human Rights.

“I reiterate my call to all OSCE participating States to decriminalize defamation and insult,” Mijatović said. “Legal reforms, guaranteeing that only reasonable damages can be awarded by civil courts, must be initiated to satisfy grievances of people who think their reputations have been damaged.”  Vienna,  15 April 2016 © OSCE

“In order to improve the protection of Human Rights Worldwide, we need brave and active individuals who denounce shortcomings in their countries and stand up for these rights. We want to honour the work of these women and men, who demonstrate great civic courage and face significant personal risks as a result of their commitment, by awarding the Franco-German Prize for Human Rights and the Rule of Law.

We will award this prize on Human Rights Day (10 December) each year to between ten and fifteen individuals worldwide in the places where they live and work. Q-Norway is one of the European countries that has a strong bilateral relation with BiH, since the mid-1990s.  And Norway is among the biggest bilateral donors to BiH. Please give us an overview of the Norway’s contribution during recent years.

Ambassador Vibeke Lilloe: Norway has been active in BiH since the war, first with humanitarian aid and reconstruction.  We have been among BiHs major cooperation partners.  Since around 2000 focus has been on contributing to building a well-functioning democracy, based on the rule of law.  When that is said, our main sectors for cooperation with BiH are the justice sector, the security sector, economic development and support to strengthening civil society – especially its watch dog capacity and advocacy ability.  Important is of course inter-ethnic dialogue and reconciliation.  Norway is a staunch defender of human rights for all – and we cooperate with women’s and minority organizations, such as in the LGBT community.

Norway fully supports BiH’s Euro-atlantic integration processes and see membership in EU and NATO as the best way ahead for BiH.

The United States Leadership in NATO

US world affairs In an official visit to the United States, NATO Secretary General Jens Stoltenberg met with President  Obama. He met also with Secretary of Defense Ashton Carter, Secretary of State John Kerry and National Security advisor Susan Rice.  

The meeting covers discussion on range of Security issues  that are posing challenges to the U.S and Europe in the same way. The Secretary General express his gratitude to President Obama for his Leadership and the United States crucial contribution through the European Reassurance Initiative.

The Secretary General visited, on his second day, Fort Bragg in North Carolina and met with the U.S Service Personnel. During this visit he was briefed on the U.S Global Response Force which works in deployment with NATO’s High-Readiness Spearhead Force under European Allies Command.
